Privacy policy

Moustache AI (“we,” “our”) offers intelligent chatbot solutions for businesses. We are committed to protecting your privacy in accordance with the General Data Protection Regulation (GDPR). This policy explains how we collect, use, store, and share your personal data when you visit moustacheai.fr or moustacheai.com, use our chatbots, or interact with our services. It also covers the use of cookies and your rights as a data subject.

1. Data Controller

We are responsible for the processing of personal data collected through our websites and chatbot services.

2. Personal Data We Collect

We only collect the data necessary to provide our services:

  • Provided by you: name, email, phone number, and the content of your requests when you contact us, subscribe to the newsletter, book an appointment, or use our chatbots.
  • Collected automatically: IP address, device type, browser details, and usage data when you visit the site or interact with our chatbots.
  • Cookies: data on site browsing, preferences, or the history of conversations with our chatbots (see Section 7).
  • From our clients: if you use the chatbot of one of our clients, we process your requests or order details on their behalf.

We process data pursuant to Article 6 of the GDPR:

  • Consent: marketing emails and non-essential cookies.
  • Contract: provision of our chatbot services and account management.
  • Legitimate interests: improving our services and site security, unless your rights override these interests.
  • Legal obligation: compliance with the law, tax filings, or data breach notifications.

We use your data to:

  • provide and improve chatbot services, and maintain conversation context;
  • respond to your requests or provide you with support;
  • analyze site usage to improve its performance;
  • send marketing communications with your consent.

4. Data Sharing

We share data only when necessary:

  • Service providers: hosting, audience measurement, appointment booking, and email sending, under GDPR-compliant contracts (see the list below).
  • Clients: request data shared with the client companies that use our chatbots.
  • Authorities: where required by law (for example, a request from the CNIL, the French data protection authority).

Processing takes place within the European Union. In the event of a transfer outside the European Union, we use standard contractual clauses compliant with the GDPR (Article 46).

Services Used by This Site

  • Hosting: Clever Cloud SAS, in France.
  • Audience measurement: Matomo, installed on our own servers (analytics.moustacheai.com), without cookies and with anonymized IP addresses. Data is not transmitted to any third party.
  • Conversational agent: our own Moustache AI solution, hosted in Europe.
  • Appointment booking: Calendly, on the Pain Point Scan booking page, loaded only if you display the calendar. Information entered in the calendar is processed by Calendly, under its own privacy policy.
  • Videos: YouTube videos in articles are only loaded upon clicking, from youtube-nocookie.com.

5. Data Retention

We retain your data only for as long as necessary:

  • Account data: until the account is closed, plus 6 months.
  • Chatbot requests: 12 months, to improve our services.
  • Marketing data: until you unsubscribe.
  • Contact requests: for the duration of their processing and any resulting sales follow-up, for a maximum of 3 years after the last exchange.
  • Cookies: see Section 7.

Data is then deleted or anonymized.

6. Your Rights

Under the GDPR, you may:

  • access your data;
  • rectify it;
  • erase it;
  • restrict its processing;
  • receive it in a usable format (portability);
  • object to marketing or to processing based on legitimate interest.

Commands you can use in our chatbots:

  • “Show my data” to access it;
  • “Delete my data” to erase it;
  • “Unsubscribe” to stop receiving marketing communications.

7. Cookies and Tracking Technologies

The site sets no advertising or tracking cookies:

  • Essential storage: necessary for the site to function and to remember the chatbots' conversation context. It cannot be disabled.
  • Audience measurement: Matomo, without cookies and with anonymized IP addresses, in the configuration the CNIL exempts from consent. You can opt out from the Cookie Policy.

Calendly and YouTube only load, with their own cookies, if you use them. Full details are provided in the Cookie Policy.

8. Data Security

We protect your data through:

  • encryption of messages exchanged with the chatbots;
  • internal access controls;
  • anonymization where possible.

In the event of a data breach, we notify the CNIL and the affected individuals within 72 hours (Article 33 of the GDPR).

Our services may contain links to client or partner websites. We are not responsible for their privacy practices.

10. Protection of Minors

Our services are not intended for individuals under the age of 16. Data concerning them is deleted as soon as it is identified.

11. Updates

This policy may be updated; the version in effect is always published on this page. Significant changes are notified by email or via our chatbots.
