1. Scope

These general terms and conditions of sale (Terms of Sale) apply exclusively to relationships between professionals (SMEs, mid-sized companies, large groups) in connection with the use of the solutions offered by Moustache AI.

Any order or signature of a contract implies unreserved acceptance of these Terms of Sale.

2. Description of Services

Moustache AI offers:

  • SaaS software enabling the creation and operation of AI-based conversational and/or voice agents;
  • related services, which may include, as applicable: initial setup, configuration, consulting, guidance, premium support.

The exact scope of the services, their terms, duration, and price are defined in the specific contract or quote entered into with the client.

3. Access to the Service

The service is accessible via an online interface. The client is responsible for:

  • configuring its agents;
  • the content, data, and instructions it provides;
  • the use it makes of the responses generated by the agents.

4. Liability and Artificial Intelligence

Moustache AI provides an assistance tool based on artificial intelligence models.

The responses generated by the agents:

  • are produced automatically;
  • depend on the data, rules, and instructions provided by the client;
  • may contain approximations or errors.

Moustache AI is not liable for any decisions, actions, or consequences resulting from the use of the generated responses.

Moustache AI's liability is strictly limited to a best-efforts obligation, to the exclusion of any obligation to achieve a result.

5. Data and Confidentiality

Data provided by the client is:

  • used exclusively for the client's needs;
  • not pooled;
  • not used for the purpose of global retraining of the models.

The hosting and processing infrastructure is located in the European Union and/or in France, depending on the technical choices made.

Each party undertakes to respect the confidentiality of the information exchanged in connection with the contractual relationship.

6. Financial Terms

Pricing terms, billing arrangements, payment schedules, and any commitments are defined on a case-by-case basis in the contract or quote accepted by the client.

7. Term and Termination

The term, and the conditions for renewal and termination, are those set out in the specific contract entered into between the parties.

8. Intellectual Property

Moustache AI remains the owner of all rights relating to its software, technologies, know-how, and methods.

The client retains full ownership of its data, content, and configurations.

9. Governing Law and Disputes

These Terms of Sale are governed by French law.

In the event of a dispute, the parties shall endeavor to reach an amicable solution. Failing that, the courts within the jurisdiction of Moustache AI's registered office shall have exclusive jurisdiction.
